Lookfilter.com is part of the Candela Project GmbH.

The following Terms and Conditions are a legal agreement (hereinafter called “agreement”) between you (“You”, “Your”. “User” or “Customer”) and Lookfilter.com (“We”, “Us” or “Lookfilter.com”), the owner and operator of the www.lookfilter.com website ( “site” or “page”). This agreement states the terms and conditions that govern your use of the site and all products sold on it. Please read this agreement carefully before you using our site and purchasing our products.

Acceptance of the terms and conditions

By accessing or entering our site or puchasing our products, you agree to this Agreement and our Privacy Policy no matter if you are registered or not. If you don’t agree to all terms and conditions you are not permitted to access the site and/or purchase any of our products.

Terms of sale

By accessing the site and purchasing any Lookfilter product you represent, acknowledge and agree that you are at least 18 years of age. If you are under 18 years of age you have to be at least 13 years old. In this case you are only allowed to use the site with the consent of your parent or legal guardian. By accessing the site and/or purchasing any Lookfilter product you represent, acknowledge and agree that you have received your parent or legal guardian’s permission to enter into this agreement. If you are a parent or legal guardian who is registering for a child, you hereby agree to bind your child to this agreement and to fully indemnify and hold harmless Lookfilter.com if your child breaches or disaffirms any term or condition of this agreement.

No one, for any reason, is permitted to copy the photographs, logos, patents, trademarks, service marks, text and user content belonging to other users appearing on the pages of this website without written permission from Lookfilter.com. The permission has to be obtained in advance.

All products of Lookfilter.com are copyright protected. You are not allowed to change, modify, alternate, sell, copy, distribute or reproduce our products in any way.

Use of Lookfilter products

You are only allowed to use Lookfilter products for your own usage. By purchasing you agree not to share them with any other user (friends, relatives, colleagues, etc.) or to resell our products. All rights and privileges conferred are personal and non-transferable. You are allowed to make a back up copy of your Lookfilter product for your own use. You can use Lookfilter products on more than one (1) of your personal computers. You agree not to change or modify your purchased Lookfilter products in anyway. Lookfilter products are copyright protected and shall not be transformed.

Password

Maintaining the confidentiality of your password underlies your own responsibility. You are also responsible for all activities that occur using your passwords. You agree not to share, let anyone else use or access your password. You should inform Lookfilter.com of any unauthorized usage of your password. Lookfilter.com is not liable for any losses caused by any unauthorized use of your account.

Security

Lookfilter.com takes the protection of your personal information very seriously. Nevertheless it can happen that unauthorized third parties defeat Lookfilter.com’s safety measures and use the information you entered for improper purposes.  Lookfilter.com is not liable to any losses caused by the unauthorized usage of your data.

Links/Third party websites

You may find links to third party sites on our website. These are not owned and therefore not controlled by us, this includes, without any limitation, Facebook and Twitter. We do not review, approve, endorse, or make any representations about such third party Sites, the companies or persons who own and/or operate them, or any information, software or other products and services made available by them. We provide such links as convenience to you and rely on your own judgement. It is your decision to enter or use such a third party site. Lookfilter.com is not responsible and liable for the content of third party websites.

Price changes

Lookfilter.com reserves the right to change or modify the prices of our products at any time. This will happen with or with out notice and can be just temporarily or permanently.

Refund

Due to the nature of the digital products we sell and the industry’s standards Lookfilter.com does not provide refunds for any reason. Returns are not accepted under any circumstance.

There are no refunds for the cancellation of your account. Lookfilter.com will not provide any refund for any content or data associated with you as the user and your account, whether we suspended or terminated your account or you cancelled it. No refund is provided in anyway.

Risk of Loss

All financial actions made in the process of purchasing Lookfilter products will be handled by a third party payment processor (PayPal). This will proceed in accordance to the respective terms and conditions, to the use, privacy policy and any other applicable term of the third party.  Lookfilter.com is not responsible and liable for any actions, inactions or mistakes of any third party payment processor.

Software requirements

You need Adobe Photoshop® (CS 3-4-5-6) to run your purchased Lookfilter products. Only use original and licensed versions of Photoshop® to achieve a correct und smooth run of the droplets. We have build and tested our products in Adobe Photoshop®. For the usage of our products for Mac OS 10.5 – 10.8 (OS X) is required. For Windows at least XP and all following operating systems are required. You have to be in full possession of all administrative rights for the software you are using, if those are required to make changes in the settings. With this agreement you have been notified and agreed on these circumstances. You’re responsible to comply to this requirements.

Community/User Content

The user is solely responsible for every comment, user information and images (user content) he or she posts, send or uploads. Lookfilter.com is in no case responsible or liable for any user content posted or uploaded by you, any other user or third party onto our site. The user is responsible for content and the consequences of posting, uploading and publishing it. Lookfilter.com only serves as a passive platform for user content and its publication. With this agreement you acknowledge that you might be confronted or exposed to user content that is objectionable, inappropriate for children or inappropriate in anyway. You agree that Lookfilter.com is not responsible and liable for any damages you allege to incur through user content.

With this agreement you acknowledge and agree that Lookfilter.com is allowed to publish your user content on all pages of www.lookfilter.com and on all of their socialmedia platform presences (incl. Facebook, Twitter, Pinterest, Flickr, Tumblr., About me.). Lookfilter has the right to publish, resize and translate the user content and your name, in whole or in part.

By posting, sending or uploading any user content the user grants, represents and warrants that he or she has all rights necessary and that he or she is not violating any kind of copyright.

Lookfilter.com do not have to pay the user of any user content in any way. All user content is voluntarily and offered for free to Lookfilter.com by the user.

No Warranty

The site, content, products and memberships are furnished to you “as is“ and without warranties, representations or conditions, statutory or otherwise, of any kind. Lookfilter.com expressly disclaims all representations, warranties and conditions whether express, implied or statutory, including, without limitation, the implied warranties of non-infringement, title, merchantability, and fitness for a particular purpose. Lookfilter.com does not represent or warrant that the site, content, products or memberships will meet your requirements, or that the operation of the site or content will be timely, uninterrupted, stable, or secure. Lookfilter.com does does not represent or warrant that the site, content, products or memberships will be error-free or that any defects will be corrected. Lookfiler.com does not make any representations, warranties, or conditions regarding the use of the use of the site, content or products in terms of their accuracy, reliability, timeliness, completeness, or otherwise. Your use of the site, content, products or memberships is entirely at your own discretion and risk and you assume total responsibility for your use of the site, content, products and memberships.

This limitation of remedies is a part of the bargain between you and Lookfilter.com. No oral or written information or advice given by Lookfilter.com or any person on behalf of Lookfilter.com shall create warranty or condition, or in any way change this exclusion of warranty.

Nothing in this section shall exclude or limit Lookfilter’s warranties, representation or conditions to the extent they may not be lawfully excluded or limited by applicable law, in which case, such warranties, representations or conditions will be excluded and limited to the greatest extent permitted by applicable law.

Limitation of liability

In no event shall Lookfilter be liable to you, or any third party, for any special, indirect, incidental, punitive, exemplary, reliance or consequential damages of any kind, including, but not limited to, property damage, loss of value of the products or loss of use of the products, whether based on breach of any express or implied warranty or condition, breach of contract or tort (including, without limitation, negligence or strict liability), even if Lookfilter has been advised of the possibility of such damages.

If, notwithstanding the foregoing, Lookfilter is found to be liable to you or any third party for any damage or loss which arises under or in connection with your use of the site, content, products or memberships, Lookfilter’s total cumulative liability shall in no event exceed the greater of: the amount you paid Lookfilter.com for the products, as applicable.

Nothing in this section shall exclude or limit Lookfilter’s liability for losses which may not be lawfully excluded or limited by applicable law, in which case, Lookfilter.com’s liability will be limited to the greatest extent permitted by law in the applicable jurisdiction.

Sie können Lookfilter Produkte auf mehr als einem (1) Ihrer persönlichen Computern verwenden. Sie stimmen zu ihre gekauften Lookfilter Produkte nicht zu verändern oder zu modifizieren. Lookfilter Produkte sind urheberrechtlich geschützt und dürfen nicht verändert werden.

Kennwort

Die Wahrung der Vertraulichkeit Ihres Passworts unterliegt Ihrer eigenen Verantwortung. Sie sind auch verantwortlich für alle Aktivitäten, die mit Ihrem Passwort auftreten. Sie stimmen zu ihr Passwort nicht weiter zu geben, es von irgendjemand Anderem nutzen zu lassen oder dritte auf ihr Passwort zugreifen zu lassen. Sie sollten Lookfilter.com über jede unerlaubte Nutzung Ihres Passwortes informieren. Lookfilter.com haftet nicht für Schäden, die durch eine unbefugte Nutzung Ihres Kontos verursacht wird.

Es gibt keine Rückerstattung für die Kündigung Ihres Kontos. Lookfilter.com wird keinerlei Rückerstattung für Inhalte oder Daten, die mit Ihnen als Anwender und Ihrem Konto verbunden sind, egal ob wir ihr Konto kündigen oder blockieren oder Sie es kündigen. Ein keiner Weise wird eine Rückerstattung geleistet.

Software Anforderungen

Mit dieser Vereinbarung wurden Sie darüber unterrichtet und stimmen diesen Umständen zu. Sie sind dafür verantwortlich, das ihre Software diese Anforderungen erfüllt.

Community / Benutzerinhalte

Der Benutzer ist allein verantwortlich für jeden Kommentar, Informationen und Bilder (Benutzerinhalt), die er oder sie veröffentlicht, sendet oder hochläd. Lookfilter.com ist in keinem Fall verantwortlich oder haftbar für den von Ihnen, einem anderen Benutzer oder einem Dritten auf der Website hochgeladenen Inhalt.
